Public Space Protection Orders

Consultation begins for the new Public Spaces Protection Order - 21st July - 17th August 2025

A Public Spaces Protection Order (PSPO) is made under the Anti-Social Behaviour, Crime & Policing Act 2014. It means that anti-social behaviour may be dealt with by the issuing of a £100 Fixed Penalty Notice (FPN) by a Police Officer, Police Community Support Officer (PCSO) and District Council Enforcement staff.

The District Council’s current PSPO expires 9th October 2025 and includes restrictions / controls, in various public parks and open spaces throughout the Dales

A consultation exercise is taking place 7th July to 17th August which will includes:-

  • Prohibition of open fires and BBQs (consultation commences 7th July)
  • Prohibit dog fouling (consultation commences 21st July)
  • Impose restrictions on the walking or exercise of dogs (consultation commences 21st July)
  • Prohibit the consumption of alcohol (consultation commences 21st July)
  • Prohibit parking & driving (consultation commences 21st July)

Any representations will be collated and a report will be presented to the Community & Environment Committee 11th September, to consider any representations and approve the new Public Space Protection Orders. Updates, as available, will be posted on the website and via social media.

2025 Draft Prohibition of open fires and BBQS on Moorland

With regard to the BBQs and Fires control, the District Council is proposing to extend prohibited activities to include:-

  • The lighting of fires;
  • The lighting or use of stoves, barbecues and other devices using an open flame;
  • The discarding of lighted matches and other things likely to cause fire;

It is proposed that this will apply to:-

  • Land to which the public or any section of the public has access, on payment or otherwise, as of right or by virtue of express or implied permission; and
  • Land which is in the open air and is:
    • listed in Schedule 1 of this Order;
    • access land within the meaning of Part 1 of the Countryside and Rights of Way Act 2000,
    • Restricted byway within the meaning of section 48 of the Countryside and Rights of Way Act 2000,
    • cycle track, footpath or bridleway within the meaning of section 329 of the Highways Act 1980, or
    • highway over which the public have a right of way for vehicular and all other kinds of traffic, but which is used by the public mainly for the purpose for which footpaths and bridleways are so used.

Draft Public Spaces Protection Order - BBQs and Fires Moorland - July 2025.

The police, Police Crime Commissioner, fire authority, Peak District National Park Authority, Derbyshire County Council, affected landowners and affected Town & Parish Councils as statutory consultees will be contacted with regards to the proposals.

As part of the consultation, the District Council is also considering the inclusion of any other publicly accessible nominated land and is in touch with local major land holders. If any landowner is interested in proposing their land for inclusion, in the BBQs & Fires control, please could they complete an Expression of Interest form www.derbyshiredales.gov.uk/PSPOEOI

We would require contact details of the landowner, land registry number/documents and for the location to be indicated on a map.

2025 Draft Dog Control Order

  • Prohibit dog fouling – this covers any land within the administrative area of Derbyshire Dales District Council which the public or any section of the public has access, on payment or otherwise, as of right or by virtue of express or implied permission. If a dog defecates at any time on the said land and the person who is in charge of the dog at the time, fails to remove the faeces from the land forthwith, shall be guilty of an offence.
  • Impose restrictions on the walking or exercise of dogs
  • Dog exclusion

Proposed Draft Park Order 2025-2028

Current PSPO restrictions expire 9th October 2025.

The District Council's Public Spaces Protection Order (PSPO) has been renewed with effect from 10th October 2022. The Order helps to ensure that the Dales remains a clean, green and safe place for residents and visitors.

The Order (please check site signage for any restrictions that apply) includes restrictions / controls, in various public parks and open spaces throughout the Dales, on:

  • Dog fouling and dog control
  • Consumption of alcohol
  • Ban of Open fires and BBQs

Dog fouling and dog control

The Order means that it is an offence to not clear up after your dog on any land that is open to the public whether it be public or private land. Dog walkers should carry something to collect their dog mess such as poo bags or a carrier bag - we encourage you to use degradable bags where possible. If your dog makes a mess in a public place, please pick up the mess in your bag, seal it and dispose of it in a dog waste bin, litter bin or take it home to put in your domestic waste bin.

There are also some other controls for dogs to be kept on leads in some places, lead by direction in some places and dogs are excluded from some places such as children’s play areas.

Consumption of alcohol

The control means that a person must stop drinking alcohol if asked to by a Police Officer, Police Community Support Officer (PCSO) or District Council Enforcement staff.
